- What kind of taxes are caregivers expected to pay?
In addition to the annual registration fee of $300 per patient, caregivers will be required to pay state sales tax on all sales of medicine to their patients. We are waiting to get an appropriate contact at the state's division of taxation in order to get the full details of this, and John will be helping us with that (Thanks John!)
- Drug Testing at the Workplace – will patients have any protections about being drug tested at the workplace if they hold a valid state ID card?
Yes. There are numerous protections in the law, which includes non-discrimination policies for landlords and employers. A worker cannot be fired for simply testing positive for MJ while holding a valid state ID for it's use.
- Confidentiality – In what cases, if any, will the state release registration information on caregivers and/or patients to authorities, either local, state or federal?
The state will never release this information to anyone. There are only 3 people with access to the registry at the state. When pressed on the issue of a potential inquiry by federal authorities (like the DEA), we were told the state would not release any information to these people, for any reason, ever.
- Can a caregiver have multiple rooms at their location, so long as they are still within the guidelines set forth by the law (only have 6 flowering plants per registered patient)?
Yes. The number of rooms a caregiver has does not matter as long as they are within the guidelines of the law. This allows a caregiver to have a veg room and a flowering room at the same location.
- Is there a system in place to make changes to paperwork, such as a change of address, or if a patient would like to switch caregivers?
Yes, CCM has worked out an arrangement whereas we can take care of these changes for our members via email directly with John. For any changes like this, there will be a $10 administrative change fee, which needs to be mailed into the state.
- What are the conditions for a non-growing caregiver, same as a growing caregiver?
Yes, a non-growing caregiver is allowed to possess, and distribute the same amounts of medicine for their patients as a growing caregiver, but simply cannot grow medicine. Non-growing caregivers also do not have to pay the $300 annual registration fee to the state.
- Can a person's children be taken away for using MMJ?
No. This is included in the section about non-discrimination referenced above.
- Will veterans possibly lose their benefits for being a part of this program?
Since veterans benefits are a federally administered program, this is always possible. The state cannot ensure that a veteran would not lose their benefits in this scenario.
- Due to the current backlog of paperwork, are completed registration documents acceptable to present to authorities, should that situation arise?
Yes, keep a copy of your completed paperwork in your possession for now, until you receive your card in the mail.
- Regarding outdoor cultivation, what is the state's position on that?
It should not be in a residential area, and it will need to have a secure locked fence at the very least. Greenhouses are ideal.
Couple of items worth noting:
1. The initial rush of applications is now over. The state had been receiving about 30 applications per day as recent as 10 days ago, but that number has now dropped dramatically to only about 8 per day or so. This means that the state will be getting caught up in the near future, and we can expect the turnaround times on paperwork and registrations to be much quicker in the weeks ahead.
2. There are a couple of questions that went unanswered (one regarding school zones, as well as hemp cultivation for other purposes other than MMJ) but we should be getting answers for those items soon, and I will update this page with that info once we get it.
